Five years jail term to former Telecom Minister



(IANS) A Delhi court Saturday sentenced former telecom minister Sukh Ram, 84, to five years rigorous imprisonment for misusing his official position when he was in the P.V. Narasimha Rao cabinet. This was his third conviction on corruption charges.

Special Central Bureau of Investigation (CBI) Judge R.P. Pandey said: "After giving my thoughtful consideration to all the relevant aggravating and mitigating factors, I sentence convict Sukh Ram to undergo rigorous imprisonment for four years with a fine of Rs.1.5 lakh for offence committed by him under section 7 of the PC (Prevention of Corruption) Act."

Sukh Ram is further sentenced to undergo rigorous imprisonment for five years with a fine of Rs.1.5 lakh for offence committed by him under sections 13 (1) (d) and section 13 (2) of the act, he said.

He also got another three-year term with a fine of Rs.1 lakh for offences under section 120-B (criminal conspiracy) of the Indian Penal Code, and sections 7 and 13 (1) (d) and section 13 (2) of the act.

All the sentences shall run concurrently.

Sukh Ram was taken into custody and sent to Tihar Jail.

"The court can not remain oblivious to the fact of shaken public confidence in the efficacy of law to deal with corruption, particularly when it is the question of tackling the corruption case of high ranking public servants such as ministers and therefore the court can not afford to be excessively lenient with such convicts," the judge observed.

"It is through the public servants the policies of the legislature and government are implemented and welfare of the society can be ensured. If such public servant of the rank of minister indulges in corruption, the whole structure of the society would be destroyed and the policies of the legislature and government, howsoever beneficial they may be would gravely suffer," noted the court.

Citing Kautilya in the 11-page order, the judge said: "I find wisdom in Kautilya's philosophy that whoever imposes severe punishment becomes repulsive to people while he who awards mild punishment become contemptible. The rulers just with the rod is honoured when deserved punishment is given, it endows the subject with spiritual good, material well-being and pleasure of senses."

Sukh Ram was convicted Thursday for accepting a bribe of Rs.3 lakh from a private firm in 1996.

In 1996, he had awarded a contract worth Rs.30 crore to a private firm, Haryana Telecom Limited (HTL), for supplying 3.5 lakh km cables at inflated rates, causing a huge monetary loss to the exchequer.

Sukh Ram had been put on trial along with HTL chairman Devinder Singh Choudhary who died during the trial.

During arguments on the quantum of sentence, Sukh Ram's counsel pleaded that his client is an octogenarian and attending the trial for the past 12 to 13 years.

He also sought leniency on the grounds that his client is suffering from age-related ailments and has also lost his wife.

The CBI prosecutor, however, termed Sukh Ram as a habitual offender saying he has been sentenced in two other cases also and thus deserved no leniency.

"We should not forget that he was an MP and a minister and has betrayed the confidence of public at large," said the prosecutor.

Meanwhile, Sukh Ram said he was a victim of a political conspiracy.

"I am a victim of a political conspiracy. I will not end my fight here. I will move a higher court to get justice. I will come out clean," Sukh Ram told IANS over phone from his residence in Noida.

He was also attacked by a man in the Rohini courts complex here Saturday but escaped unhurt. The assailant, Harvinder Singh, was detained by police.

Sukh Ram has been convicted twice earlier on separate corruption charges. In 2009, he was convicted for owning disproportionate assets worth Rs.4.25 crore.

Earlier in 2002, he was sentenced to three years in jail in another corruption case, held guilty for causing a loss of Rs.1.66 crore in award of a contract to a Hyderabad-based firm for supplying some equipment.

A seven-time legislator and three time MP, Sukh Ram was expelled from the Congress in the mid-1990s.

    All the Telecom Ministers should be jailed: AS Raja

    2011/7/25 9:54:36 Former Telecom Minister AS Raja, who was resting in Tihar Jail since last few months has been brought to CBI Court to face the 2G spectrum case filed against him. He told the court that, he is innocent and incase the Telecom policy of the Government is wrong then all the Telecom Ministers worked from 1993 should be put into jail as they also commit the same mistake done by him. He said that he has just continued the Telecom policy of NDA Government and thatís why he didnít auction the 2G spectrum licenses.

    Charge-sheet against 2G Raja, Kanimoli and others

    2011/10/22 10:34:14 A special CBI court Saturday charged former communications minister A. Raja, along with others accused in the 2G spectrum case, for criminal breach of trust that could entail a maximum punishment of life imprisonment.

    Finding sufficient prima-facie evidence against Raja, the Central Bureau of Investigation (CBI) court imposed Section 409 of the Indian Penal Code (IPC) against him.

    Special Judge O.P. Saini said: "Section 409 is imposed on Raja and two of his secretaries."

    Former telecom secretary Siddharth Behura and former private secretary to Raja, R.K. Chandolia, too have been charged for criminal breach of trust.

    If, they were proved guilty in this case, AS Raja may get life term and Kanimoli may get a minimum 5 years term jail.

    Family meeting in Tihar jail

    2011/5/24 4:29:46 The arrest of MP Kanizimoli leads to a family meeting in Tihar jail. Former CM of Tamilnadu Karunanidhi accompanied all his family members went to Tihar jail to meet his daughter Kanizimoli, who was arrested by the CBI in connection with 2G Spectrum case and illegal transfer of funds to family owned Kalaingar TV.

    There was an emotional situation prevailed in the surroundings as the entire family members broke-up with tears. Keeping in view of Karunanidhiís health condition, jail officials have allowed his vehicle to go directly to the Cell No.6 where the MP is resting now. Karunanidhi family had a brief meeting with her for half an hour in the jail. Karuna also met former Telecom Minister AS Raja and Sarat Kumar.

    Later, Karunanidhi family returned to their hotel room. Home Minister P.Chidambaram has visited him and had a brief meeting with him. Karunanidhi who used to visit Sonia Gandhi in his every visit to New Delhi has skipped meeting her this time as he is angry with her for the arrest of his daughter.

    3 yrs jail for former Sri Lankan Army Chief

    2011/11/18 23:08:41 (IANS) Former Sri Lankan army chief General Sarath Fonseka was Friday sentenced to three years in jail.

    Fonseka was found guilty of spreading public disaffection by quoting allegations that surrendered Tamil Tiger rebels were ordered to be killed by the then defence secretary, Xinhua reported. He is currently serving a 30-month jail term for other offences.

    As the joint opposition candidate in presidential polls in January 2011, Fonseka was defeated by incumbent Mahinda Rajapaksa and was arrested soon after.

    Tribunal asks Vodafone to pay Rs.25 crore penalty

    2011/11/19 2:46:42 New Delhi, Nov 18 (IANS) The telecom tribunal TDSAT has directed telecom service provider Vodafone to pay Rs.25 crore penalty, 50 percent of what the Department of Telecom (DoT) had earlier levied upon it for issuing bulk SIM cards without proper verification.

    "The petitioner (Vodafone) may, therefore, deposit a sum of Rs.25 crore, being 50 percent of the amount, within two weeks from date subject to compliance of the aforementioned directions," said the Telecom Disputes Settlement and Appellate Tribunal (TDSAT) in an order dated Nov 17.

    The TDSAT bench headed by chairman Justice S.B. Sinha also said that it is difficult to accept the contention that when bulk connections of more than 10,000 connections had been given in favour of Matrix, the SIM cards could be rented out without the knowledge of the petitioner.

    "The question as to whether the stipulations contained in the impugned order are correct or not, may have to be determined at the time of final hearing," the order added.

    Vodafone had entered into an agreement with telecom solutions service provider Matrix Cellular in 2003 when it was Hutch and had issued 10,000 SIM cards for its own use which were later in an enquiry by Telecom Enforcement, Resource and Monitoring (TERM) cell of the DoT discovered to have been rented out by the operator.

    The DoT, therefore, had on Oct 18, 2011 passed an order imposing penalty of Rs.50 crore on the telecom operator.

    TDSAT said that it is of the opinion that Vodafone has violated the conditions of licence thus declining to deviate from the order passed by the tribunal in the case of Bharti Airtel and Idea Cellular.

    2G case: Behura says CBI discriminating

    2011/11/1 16:43:33 New Delhi, Nov 1 (IANS) Former telecom secretary Siddharth Behura, arrested in the 2G case, Tuesday told a special court here that the CBI was discriminating against him by not opposing the bail pleas of other accused. The court reserved its order on his bail plea till Nov 3.

    Senior advocate Aman Lekhi, appearing for Behura, told Central Bureau of Investigation (CBI) Special Judge O.P. Saini that the prosecution was making a distinction between his client and other accused seeking bail.

    It showed there was political intrusion in the legal process, he said.

    While referring to the CBI's stand of not opposing the bail pleas of five accused, including DMK MP Kanimozhi, Lekhi said: "It is a colourable exercise of power."

    "If the prosecution has conceded bail to Kanimozhi and (four) others, then all accused should be treated equally. Law makes no distinction among the accused," he said.

    "The Supreme Court has rightly asked the CBI to explain on what basis they were doing so (discriminating)," Lekhi argued.

    Special Public Prosecutor U.U. Lalit denied Lekhi's allegation against the agency saying: "I do not hold brief for anyone. I stand here as a prosecutor purely in the capacity of an impartial observer to place the facts before the court."

    Lalit said that the change in circumstances after framing of charges against Behura was detrimental to him.

    The charge sheet earlier indicted him with charges punishable up to seven years of jail term whereas now he was charged for criminal breach of trust by public servant, carrying a maximum punishment of life term.

    After all the parties concluded their arguments, Judge Saini said: "Order on bail application of accused (Behura) is reserved till Nov 3."

    The court is also likely to pronounce its verdict on the bail plea of other accused. They included Kanimozhi, Kalaignar TV chief Sharad Kumar, Cineyug Film's Karim Morani and Kusegaon Fruits and Vegetables Pvt. Ltd. directors Asif Balwa and Rajiv B. Agarwal, whose bail pleas were not opposed by the CBI.

    It will also pronounce its order on the bail application of Swan Telecom promoter Shahid Usman Balwa and former communications minister A. Raja's private secretary R.K. Chandolia.

    New telecom policy to be unveiled in January

    2011/11/4 11:33:55 New Delhi, Nov 4 (IANS) A new telecom policy which may do away with roaming charges for subscribers within the country will be announced in January 2012, Communications Minister Kapil Sibal said Friday.

    "The policy (draft) I have already announced. Industry wants some more time to respond. We will give them time. Finalisation of the policy will happen in January instead of December," said Sibal at an event here.

    Last month Sibal had unveiled the draft of the National Telecom Policy (NTP) 2011 which proposes to remove roaming charges for subscribers within the country, exponentially increase broadband availability and speed and allow for mobile numbers to be ported to any part of the country.

    The draft policy also proposes to accord the telecom industry the status of an infrastructure sector, which will help ease credit flow to companies for funding roll-out plans or expansion activities.

    Earlier the policy was to be unveiled in December.

    The currently existing policy was drafted in 1999 when India's telecom subscriber base was barely two million -- it has grown to around 900 million now.

    Speaking on the recommendations given by the Telecom Regulatory Authority of India (TRAI) on the National Telecom Policy, Sibal said the ministry has received it and will consider it.

    "The TRAI recommendations have just come. We will consider it, call telecom commission... move to cabinet."

    CBI opens 2G case during NDA regime

    2011/11/20 1:54:34 (IANS) The Central Bureau of Investigation (CBI) Friday registered a case in the allocation of additional spectrum to private telecom firms when the late Pramod Mahajan was telecommunications minister in the National Democratic Alliance (NDA) government.

    "The agency has registered a case in the allocation of additional spectrum today during the NDA's rule," said a CBI official.

    "The agency also raided the Vodafone office in Mumbai, Airtel office in Gurgaon and residences of Shyamal Ghosh and J.R. Gupta," the official added. The late Pramod Mahajan of the Bharatiya Janata Party was telecom minister between 2001-2003.

    While J.R. Gupta was the deputy director general in the telecom ministry, Shyamal Ghosh was telecom secretary.

    Earlier, the investigating agency had conducted a preliminary inquiry regarding the allocation of additional spectrum from 2001 to 2007.

    Jail term for Bollywood actor?

    Noted Bollywood actor John Abraham was given a 15 days simple imprisonment and also fined for Rs.1500 by the Metropolitan Magistrate of Mumbai west. This is a three year old case when John Abraham was enjoying the ride on his new 1100 cc bike between Khar and Dhanda cities dashed three cyclists who were passing on the same road. John, immediately rushed the three to a near by hospital but one out of those three Shyam Kasbe died after a year with prolonged illness.

    John sincerely admits that he was guilty in this case, and expressed his readiness to pay the compensation to the victimís families. But, the court imposed fine and jail term to the handsome hero. However, John Abrahamís advocate immediately brings him out on bail.

    India's first telecom business incubator in Kerala

    2011/10/27 14:21:07 Thiruvananthapuram, Oct 27 (IANS) India's first telecom business incubator will be set up in Kerala under Infosys co-founder and Executive Co-chairman Kris Gopalakrishnan.

    The Indian Telecom Innovation Hub will focus primarily on student start-ups from college campuses and would be modelled on technology incubators in the Silicon Valley, an official press release said Thursday.

    "With the launch of Telecom Innovation Hub, the aspiring young entrepreneurs of the state will get an opportunity to work closely with big companies and create path breaking technologies," said Kerala Industries and IT Minister P.K. Kunhalikutty.

    The National Science and Technology Entrepreneurship Development Board (NSTEDB) of the central government's Department of Science and Technology, Technopark and MobME Wireless have joined hands to set up the hub.

    It aims to incubate 1,000 product start-ups over 10 years and start the search for a billion dollar company from a college campus by the turn of this decade.

    Gopalakrishnan has agreed to be the chief mentor of the hub.

    This is one of the first public-private-partnership (PPP) technology business incubator in the country. Subject to the availability of land, its most likely location would be Kochi, the statement added.

    "NSTEDB is pleased to support this innovative PPP model," said NSTEDB Head and Advisor H.K. Mittal.

    2011/7/25 15:37:48 Former Telecom Minister AS Raja who comes to CBI court today to make his arguments in 2g Spectrum case, has told the court that whatever the decisions he has taken as Telecom Minister have the approval of Home Minister Chidambaram and Prime Minister Dr.Manmohan Singh. All those licenses that he has issued to the concerned were known to PM and HM and issued with their full knowledge. Hence, he argued that the court shouldnít consider that all his decisions were personal but should consider it as collective.

    His statement virtually creates havoc in the political circles in the Center. BJP is first to start its attacks on the UPA Government. BJP president Nitin Gadkari speaking to the media at New Delhi has said that, his party has been reportedly telling that, the 2G scam is much larger than it appears and there are several big names involved in it, including Prime Minister Dr.Manmohan Singh, Home Minister P.Chidambaram and Sonia Gandhi. He demanded for the resignations of PM and HM immediately.

    The DMK Party which had a two days meeting during the last two days might have chalked out this strategy of pushing PM and HM to corner with AS Rajaís statements so as it can create pressure on them and find a way to bailout Karunanidhiís daughter and other members of the party from Tihar jail.

    However, Congress party has immediately condemned AS Rajaís statement. The Congress high command is now desperately trying for the damage control. The timing of AS Rajaís statement is also made it critical for Congress party which is going to face the parliament sessions from 1st of August.

    Charges against Raja, 13 accused in 2G case

    2011/10/22 14:54:35 Ten months after his arrest, former telecom minister A. Raja was Saturday formally charged for criminal breach of trust, bribery, forgery and cheating in the controversial allocation of mobile phone spectrum, a case that rocked Prime Minister Manmohan Singh's government and became the talk of the nation.

    Along with him, DMK leader and MP Kanimozhi Karunanidhi was also charged with criminal conspiracy and criminal breach of trust. If convicted, while Raja could face a maximum sentence of life in prison, Kanimozhi could also face prison term.

    Identical charges were also framed by the Special Trial Court of the Central Bureau of Investigation (CBI) against his former aide R.K. Chandolia and former telecom secretary Siddharth Behura. The case, entrusted to the premier probe agency and involving award of scarce airwaves to new telecom players in a booming industry in 2007-08, went on to be known commonly as the 2G (second-generation spectrum allocation) case.

    "Section 409 is imposed on Raja and two of his secretaries," Judge O.P. Saini told the packed courtroom here in the presence of all the 14 arrested individuals, who included top politicians, bureaucrats and corporate honchos.

    Those guilty under Section 409 of Indian Penal Code, which related to breach of trust by a public servant, is liable to punishment that can stretch to life imprisonment or 10-year imprisonment with fine. It is a cognizable, non-bailable offence.

    Another high-profile accused, Dravida Munnetra Kazhagam's Rajya Sabha member Kanimozhi and daughter of former Tamil Nadu chief minister M. Karunanidhi, has invited charges of abetment of criminal conspiracy and criminal breach of trust under the Indian Penal Code.

    The probe agency had filed the first set of charges April 2 in which it had named as co-accused Raja, Chandolia, Behura, Swan Telecom's Shahid Usman Balwa and Vinod Goenka and Unitech Wireless' Sanjay Chandra.

    It had also named as co-accused Reliance Group's Gautam Doshi, Surendra Pipara and Hari Nayar, besides three companies - Unitech Wireless, Swan Telecom and Reliance Telecom.

    After that the supplementary charges April 25 included Kanimozhi, Kalaignar TV's chief Sharad Kumar, Cineyug Film`s Karim Morani and the directors of Kusegaon, Asif Balwa and Rajeev B. Agarwal.

    All the 14 individuals accused in the case were taken into judicial custody and lodged in Tihar Jail.

    As proceedings began Saturday, and after the charges were read and explained, each of the accused was asked if he/she had understood the content, wanted to plead guilty or seek a trial.

    After none of them pleaded guilty, Judge Saini said: "I, hereby, direct that you all be tried by this court for the afforsaid charges."

    Raja had resigned Nov 14 as the communications minister after the official auditor revealed that his policy and action on the award of scarce airwaves, a national resource, had resulted in presumptive losses worth billions of rupees to the exchequer.

    Raja was arrested by the probe agency in the national capital Feb 2, along with Behura and Chandolia, while Shahid Balwa was arrested from Pune Feb 8. Then came the custodies of Asif Balwa and Agarwal.

    Among others, the court had April 20 rejected the bail pleas of Goenka, Chandra, Doshi, Nair and Pipara and ordered judicial custody. Then May 20, Kanimozhi and Sharad Kumar, were also named accused and sent to jail, and 10 days later, Morani also joined them.

    2011/9/30 11:50:37 Arguing that there was "voluminous evidence" against Home Minister P. Chidambaram in the 2G scandal, the Bharatiya Janata Party (BJP) Friday said he should be sent to Tihar Jail.

    Quoting party president Nitin Gadkari's address at the two-day national executive meet here, BJP spokesperson Ravi Shankar Prasad accused the United Progressive Alliance (UPA) government of shielding Chidambaram.

    "Preference is being given to Chidambaram in spite of the voluminous evidence of his culpability and complicity... (this) only demonstrates the different yardsticks being followed," Prasad told reporters.

    Evidence against former communications minister A. Raja, now in jail, and Chidambaram was the same, he said. "So why is Raja in jail and Chidambaram outside. He should be sent to Tihar Jail."

    The BJP leader said the government was also stopping the Central Bureau of Investigation (CBI) from taking action against the home minister.

    Questioning the role of Prime Minister Manmohan Singh in the 2G issue, Prasad said: "PM needs to answer why spectrum pricing was kept out of the Group of Ministers (GOM)."

    "Action has been taken against Raja and many others and if more evidence is found then there will be need to investigate the role of PM in 2G," he added.

    Murugan, Santhan and Perari Velan, the 3 assassins of former Prime Minister of India late Rajiv Gandhi are counting their last days at Vellore jail in Tamilnadu, as their mercy petition was rejected by the President of India recently.

    Assistant DGP of Jails Dogra has told the media that they are waiting for the Governorís orders and once they got the orders all the three will be hanged to death at Vellore jail. In the mean time they are making arrangements to conduct their death sentence.

    Out of the 4 assassins of Rajiv Gandhi, Naliniís death sentence has been converted into life term by the Supreme Court, but rest was given death sentence in year 1999. Ever since, their mercy petitions were lying at Presidentís office and finally the present President has rejected their petitions.

    MDMK Chief ĎVycoí who openly supports the LTTE cadres has met the three in Vellore Jail on Tuesday.
